The man ignored it.
“How many times have I told you,” the woman wrote after the rape.
The man and the woman met at a dance class and began a sexual relationship.
But the woman had been clear, writes Södertörn district court: No vaginal sex without a condom.
Man: A mistake
The man, who is in his 40s, questioned whether he should use a condom. He has said that he took it to mean that the woman wanted him to have a condom for his sake, as she had recently had sex with another man.
He penetrated her with his penis and ejaculated – without a condom.
The man says it was a mistake to come inside her.
“When XXX told her that he had come inside her, she panicked, tried to push him away, started screaming at him and then ran into the bathroom,” the district court’s judgment states.
“Use the damn condom”
After the incident, the woman wrote a message to the man on Whatsapp: “How many times have I told you to use the damn condom?”
Now the man is sentenced to prison for three years. He must pay just over SEK 230,000 to the woman in damages.
The man has denied any wrongdoing. His attitude is that the sex was consensual, even though the woman wanted him to use a condom.
