The domestic worker raped 84-year-old Elsa, the court finds.
In the same judgment, it is clear that it was the municipality’s right to fire him.
– Now it feels very, very good, says Elsa to UNT.
“It is beyond reasonable doubt that the man subjected Elsa to rape”.
It writes Uppsala district court in a judgment.
– Oh, so nice! I have been very nervous before the verdict, but now it feels very, very good, says Elsa to UNT.
The background is 84-year-old Elsa who raised the alarm to the municipality that she had been raped by a man who worked in home care. It all started in the fall of 2023 when the man exposed himself to her. A manager told her that the man would never come home to her again – but six months later he opened the door with his own key and raped Elsa.
It is Upsala Nya Tidning that reported on the case in connection with their review of misconduct and suspected sexual abuse within the home care service. And now the district court gives Elsa the right, the newspaper writes.
Right to fire the man
The district court also writes: “He has therefore committed serious crimes against a person who was unable to calm himself down, even in the person’s home, within the framework of his position in home care, which places particularly high demands on the employee.”
– I would have liked this sentence two years ago, but it feels so good that it is coming now anyway, Elsa tells UNT.
What the court tried is a claim for damages that the man has directed against Uppsala municipality. After the district court has now tried the case, they give the municipality the right – it was not wrong to fire the man. The man is sentenced to pay court costs of SEK 450,000.
The case with Elsa led to the municipality of Uppsala apologizing to Elsa and the victims and implementing several measures to minimize the risk that similar things could happen again.
Elsa testified herself where she told about what she had been through.
– Everything was torn up again and I was so angry when I thought about what he did. And the thought that maybe he would get money, as some kind of reward, after what he had done. Now the right judgment has been made, she tells UNT.
